These Terms and Conditions (the “Terms”) govern access to and use of the website www.wearefiber.com (the “Website”). The Website is operated by FIBER GROUP SHPK, owner of the “We Are Fiber” brand, hereinafter “Fiber”. Access to and use of the Website are subject to these Terms. By using the Website, users undertake to comply with the applicable provisions.

2. Purpose and nature of the Website

The Website is for information purposes. It presents Fiber and its outsourcing services for customer service, back office, process management and outbound marketing, aimed at companies and professionals.

The Website may also provide access to dedicated services or platforms, including those relating to job applications and whistleblowing reports.

The content of the Website, including the descriptions of services and industries, does not constitute a binding contractual offer. Business relationships with Fiber are governed by specific contracts entered into separately.

3. Permitted use

Users may use the Website solely for lawful and informational purposes, as well as for professional purposes or purposes connected with the services and features available on the Website. In particular, it is prohibited to:

• reproduce or distribute, on any medium, content from the Website without Fiber’s prior written authorisation;
• alter, modify, disassemble, decompile or reverse engineer the Website or parts of it;
• disable, circumvent or interfere with the Website’s security features;
• attempt unauthorised access to systems, servers or data connected to the Website;
• introduce viruses, malware or other harmful code;
• use the Website in a way that impairs its operation or other users’ access to it;
• extract content or data from the Website by automated means (scraping);
• use the Website for unlawful, fraudulent, defamatory, harassing, offensive or obscene purposes;
• submit through the Website forms any false content or third-party data without being entitled to do so.

4. Breach of the Terms

Where technically possible and in a manner proportionate to the breach, Fiber may take measures to limit or prevent abusive use of the Website and may refer the matter to the competent authorities in the cases provided for by law.

5. Intellectual property

Texts, images, logos, trade marks, graphics, videos, software and any other content on the Website are owned by Fiber or its licensors and are protected by copyright and industrial property law. It is prohibited to remove or alter copyright notices and other distinctive signs.

Users may consult and use the content of the Website for information purposes and for internal use, including professional use, subject to the prohibition on reproducing, distributing or exploiting the content for any further purpose without Fiber’s prior written consent.

6. Content submitted by users

Users are responsible for the content and materials they submit through the Website and warrant that they are entitled to communicate them. Such content will be used by Fiber solely to the extent necessary to handle the request and in accordance with the applicable purposes.

The processing of any personal data contained in such communications is governed by the Privacy Policy and by any specific privacy notices that may apply.

7. Accuracy of content

Fiber takes care in preparing the content of the Website but does not warrant that it is always complete, up to date or error-free, and may amend or remove it at any time. The information published is of a general nature and does not replace specific advice.

8. Availability of the Website and force majeure

Fiber takes reasonable measures to ensure the accessibility and security of the Website but cannot guarantee continuous, uninterrupted or error-free operation. Access may be temporarily suspended, including without notice, for maintenance, updates, repairs or in the event of faults.

Fiber is not liable for interruptions or delays caused by events beyond its reasonable control, including strikes, fires, explosions, network or system failures and disruptions affecting third-party service or telecommunications providers.

9. IT security

Fiber takes reasonable measures to protect the Website from malware, bugs and other harmful elements but cannot entirely rule out their presence. Users are advised to use devices protected by antivirus software and adequate, up-to-date security systems.

10. Links to third-party sites

The Website may contain links to third-party sites or resources, such as social profiles and the platforms for job applications and whistleblowing, included for information purposes only. The presence of a link does not constitute an endorsement. Fiber does not control third-party sites and is not responsible for their content, services or privacy policies.

11. Limitation of liability

To the fullest extent permitted by applicable law, Fiber is not liable for damages arising from the use of the Website, from any temporary inability to use it or from reliance on its content, unless such damages are directly attributable to Fiber in cases where liability cannot be excluded or limited by law.

Liabilities that, under applicable law, cannot be excluded or limited remain unaffected in all cases.

13. Changes to the Terms

Fiber may amend these Terms at any time by publishing the new version on the Website with an indication of the update date. Amendments apply to access occurring after publication. Users are invited to consult this page periodically.

14. Governing law and jurisdiction

These Terms are governed by Albanian law, without prejudice to any mandatory provisions that may apply to the user.

For disputes with professional users, the Court of Tirana, Albania, shall have exclusive jurisdiction, where such jurisdiction clause is validly applicable and within the limits permitted by applicable law.

Where the user qualifies as a consumer, the mandatory protections and rules of jurisdiction provided for by applicable law remain unaffected.

15. Language versions

These Terms are available in several languages. In the event of discrepancies between the different language versions, the Italian version shall prevail.

16. Final provisions

If any clause of these Terms is found to be invalid or ineffective, the remaining clauses remain fully valid. Fiber’s failure to exercise a right does not constitute a waiver of it.
